Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the NSW Will Generator ("Service") provided by Hanna Law Group Pty Ltd (ABN 72 664 301 339) ("we", "us", "our"). By using our Service, you agree to these Terms.

The Service is operated by Roy Hanna, Australian Legal Practitioner (Solicitor), admitted to practice in New South Wales.

2. Nature of Service

2.1 Document Preparation Service

The Service is a document preparation service, not a legal advice service. We prepare Will documents based solely on the information you provide through our online form.

2.2 What We Do NOT Do

• We do not verify the accuracy or completeness of information you provide
• We do not assess whether a Will is appropriate for your circumstances
• We do not advise on estate planning strategies or tax implications
• We do not advise on the validity of your Will in other jurisdictions
• We do not represent you in any legal proceedings

2.3 Solicitor Review Package

If you purchase the Solicitor Review package, Roy Hanna will review your Will for obvious errors, inconsistencies, or concerns before release. This review does not constitute comprehensive legal advice about your estate planning needs.

3. Eligibility

To use this Service, you must:

• Be at least 18 years of age
• Be of sound mind and have testamentary capacity
• Be a resident of New South Wales, Australia
• Not have circumstances that our screening process identifies as requiring personalised legal advice (including but not limited to: self-managed super funds, business ownership, overseas assets, or blended families)

4. Your Responsibilities

You are responsible for:

• Providing accurate and complete information
• Ensuring beneficiary names match their legal identification exactly
• Understanding the contents of your Will before signing
• Properly executing your Will in accordance with the instructions provided
• Storing your Will safely and informing your executor of its location
• Updating your Will when your circumstances change
• Seeking independent legal advice if you have any doubts about whether this Service is appropriate for you

5. Execution of Your Will

Your Will is not legally valid until properly signed and witnessed. You must:

• Sign your Will in the presence of two adult witnesses (both present at the same time)
• Ensure your witnesses are not beneficiaries or spouses/partners of beneficiaries
• Have both witnesses sign in your presence and in the presence of each other

We provide execution instructions with your Will. Failure to follow these instructions may render your Will invalid.

6. Pricing and Payment

6.1 Fees

Current pricing is displayed on our website. Prices are in Australian dollars and include GST. We reserve the right to change prices at any time, but changes will not affect orders already placed.

6.2 Payment

Payment is processed securely through Stripe. We do not store your credit card details.

6.3 Refunds

Due to the nature of digital document delivery:

• Standard Will: No refunds once the document has been downloaded
• Solicitor Review: Full refund available if requested before the review is completed and document released
• Add-on Services: Refunds at our discretion prior to service delivery

Refunds may be provided at our discretion if there is a technical error preventing document delivery.

7. Intellectual Property

The Will template, website content, and all associated materials are owned by Hanna Law Group Pty Ltd. You receive a personal, non-transferable licence to use your generated Will document for its intended purpose. You may not:

• Reproduce or distribute our templates
• Reverse engineer or attempt to extract our document generation systems
• Use our materials to create a competing service

8. Limitation of Liability

8.1 No Guarantee

We do not guarantee that your Will, once properly executed, will achieve your intended outcomes. Estate distribution is subject to laws regarding family provision claims, creditor claims, and other matters outside our control.

8.2 Limitation

To the maximum extent permitted by law, our liability for any claim arising from or related to this Service is limited to the amount you paid for the Service. We are not liable for any indirect, consequential, special, or punitive damages.

8.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted or modified by agreement.

9. Professional Standards

Hanna Law Group Pty Ltd's liability is limited by a scheme approved under Professional Standards Legislation. Further information about the scheme is available from the Law Society of NSW.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
